By creating an account or using Stoop ("the Platform"), you agree to these Terms of Service. If you do not agree, you may not use the Platform. Stoop is operated by Stoop Sitters LLC.
Stoop is a marketplace that connects families with independent caregivers (sitters, nannies, and tutors). Stoop is not an employer of any caregiver and does not employ, supervise, or control the caregivers who use the Platform. All caregivers are independent contractors. You are solely responsible for selecting, hiring, paying, and supervising any caregiver you engage through the Platform.
Stoop may facilitate background check requests through a third-party provider. Background checks are limited in scope and do not guarantee the safety or suitability of any caregiver. Stoop makes no representation or warranty regarding the accuracy or completeness of any background check. You are encouraged to conduct your own due diligence, including reference checks and in-person interviews.
Stoop is a connector and does not handle, hold, or process payments between parents and service providers (sitters, nannies, tutors, etc.). All payment terms — including rate, method, and timing — must be coordinated and settled directly between the parties. Stoop is not responsible for any payment disputes, non-payment, or financial arrangements between users.
Subscription fees are billed through Base44 Payments on a recurring basis until canceled. You may cancel your subscription at any time; access continues until the end of the current billing period. Background check fees are one-time, non-refundable charges that cover the cost of processing through our third-party provider.
Prices are subject to change. Subscription prices, plan features, and one-time fees may change from time to time. We will post the current prices in the app and, for a change to a subscription you are already paying for, give you notice in the app before the change takes effect. A price change never applies retroactively to a period you have already paid for, and you may cancel at any time if you do not accept a new price.
To the maximum extent permitted by applicable law, in no event shall Stoop Sitters LLC, its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of, or inability to use, the Platform, or any interaction with another user, including any caregiver. Without limiting the foregoing, Stoop shall not be liable for: (a) personal injury, property damage, or any harm arising from the conduct of any user; (b) any negligence, malpractice, or misconduct by a caregiver; (c) payment disputes or financial losses between users; (d) any unauthorized access to or use of your account; or (e) any claims based on breach of warranty, breach of contract, or tort. The aggregate liability of Stoop for all claims arising from the Platform shall not exceed the amount you paid to Stoop in the preceding twelve (12) months, if any. Some jurisdictions do not permit the exclusion or limitation of certain damages, so the above limitations may not apply to you.
To the extent permitted by law, you hereby release, indemnify, defend, and hold harmless Stoop Sitters LLC, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, demands, suits, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Platform; (b) any interaction with another user, including any caregiver you engage through the Platform; (c) your violation of these Terms or any applicable law; (d) any actual or alleged negligence, misconduct, or breach of duty by any caregiver; or (e) any personal injury, property damage, or other loss arising from services arranged through the Platform. This release and indemnification survives the termination of your account or these Terms.
The Platform is provided on an "as is" and "as available" basis. Stoop does not warrant or guarantee the conduct, safety, reliability, identity, qualifications, or suitability of any user, including any caregiver. Stoop makes no representation that any background check, reference, or profile is accurate, complete, or current. You assume all risk associated with using the Platform and engaging with other users. Any reliance on any user's profile, communications, or services is at your sole risk. You are solely responsible for verifying the identity and suitability of any user and for conducting your own due diligence, including reference checks and in-person interviews.
Stoop provides a reporting tool within the app that allows any user to report another user for conduct that violates these Terms or applicable law, including safety concerns, harassment, misrepresentation, payment disputes, or other issues. Reports are reviewed by Stoop's administrators, who may investigate and take appropriate action — including warnings, account suspension, or permanent banning — at their sole discretion. Stoop does not arbitrate disputes between users and is not responsible for resolving disputes regarding payments, services, or conduct. If you have a dispute with another user, you are encouraged to use the in-app reporting tool and, where appropriate, contact law enforcement.
